How to appeal a denied claim

If you disagree with a VA decision, you can ask for a review. There are 3 main choices, called decision reviews.

What you may need

  • Your VA decision letter
  • Any new evidence, like new medical records (for some options)

Steps

  1. Step 1: Read your decision letter closely

It explains why the VA decided what it did. It also lists your deadline. In most cases, you have 1 year from the date on the letter.

  2. Step 2: Choice 1: Supplemental Claim

Pick this if you have new evidence the VA has not seen. Form: VA Form 20-0995.

  3. Step 3: Choice 2: Higher-Level Review

A more senior reviewer looks at the same evidence again. You cannot add new evidence. Form: VA Form 20-0996.

  4. Step 4: Choice 3: Board Appeal

A Veterans Law Judge at the Board of Veterans’ Appeals reviews your case. This can take longer. Form: VA Form 10182.

  5. Step 5: Get free help choosing

A Veterans Service Officer (VSO) or accredited representative can help you pick the best option for free.

Deadlines matter. Check your own letter for your exact deadline, and call if you are not sure.
